Terms and conditions for using NexPath

1. Acceptance of Terms
By accessing or using NexPath ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you") and NexPath Oy ("Company," "we," "us"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
NexPath is a multilingual career guidance platform that provides:
- Psychology-based career assessments (RIASEC, Work Values, Work Styles)
- Personalized career recommendations using dual taxonomies (ESCO + O*NET)
- Career path exploration powered by NexPlanner™ algorithm (2,796 validated paths)
- Counselor and administrator dashboards for institutional users
- Multilingual support (dozens of languages, growing)
The Service may be updated, modified, or discontinued at any time without prior notice.
3. User Accounts
3.1 Account Creation
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and update your information to keep it accurate
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
You are responsible for all activities under your account. We are not liable for losses due to unauthorized use of your credentials.
3.2 Age Requirements
For users under 16, we require verifiable parental consent — or, where a school or organization is the data controller, that organization's authorization — before an account is activated, in line with GDPR Article 8. If parental consent is requested but not confirmed within 7 days, the account and its data are automatically deleted. By creating an account, you confirm you meet these requirements.
3.3 Institutional Accounts
If your organization (school or practice) provides access to NexPath, your use is also governed by your organization's agreement with us. In case of conflict, the organizational agreement takes precedence.
4. Acceptable Use
4.1 Permitted Use
You may use the Service for:
- Personal career exploration and guidance
- Educational purposes within authorized institutions
- Workforce development within authorized organizations
4.2 Prohibited Use
You may NOT:
- Reverse engineer, decompile, or attempt to extract source code
- Use automated tools (bots, scrapers) without written permission
- Share access codes or account credentials with unauthorized users
- Submit false or misleading assessment responses to manipulate results
- Use the Service for discriminatory, illegal, or harmful purposes
- Interfere with security features or system integrity
- Resell, redistribute, or sublicense access to the Service
5. Intellectual Property
5.1 Our IP
NexPath and the NexPath logo, together with Counselor OS™, NexProfile™, NexPlanner™, NexPilot™, NexRise™ and NexReach™, are trademarks of NexPath Oy. These marks, our algorithms, assessment methodologies, and all content (excluding user-generated content) are protected by copyright, trademark, and other intellectual property laws. All rights reserved by NexPath Oy. You may not use our trademarks without our prior written permission.
5.2 User Data
You retain ownership of your assessment responses and personal data. By using the Service, you grant us a limited, non-exclusive license to process your data as described in our Privacy Policy to provide the Service.
5.3 Third-Party Data
The Service incorporates data from:
- ESCO: European Skills, Competences, Qualifications and Occupations (European Commission, CC BY 4.0)
- O*NET: U.S. Department of Labor Occupational Information Network (public domain)
These datasets are used under their respective licenses and are not part of our proprietary IP.
6. Fees and Payment
6.1 Pricing Plans
Current pricing for all plans is available at nexpath.app/pricing and forms part of these Terms. In outline:
- Individual assessments: Free, self-service — you can start a free trial without contacting us.
- Schools & educational institutions: Annual institutional licenses, tiered by cohort size.
- Career & integration practices: Per-seat subscriptions with a client-credit wallet that scales with your caseload.
Because pricing and plan structure can change, the pricing page — not this document — is the authoritative source for current prices, tiers, and included features. Institutional customers' specific terms are governed by their signed agreement with us.
6.2 Payment Processing
All online payments are processed securely by Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service. NexPath does not store credit card numbers or payment credentials.
- Currency: All prices are in EUR (Euro). Applicable taxes (VAT) are calculated and added at checkout based on your location.
- Payment Methods: Credit/debit card for online payments. Institutional accounts may request invoicing.
6.3 Subscription Terms
- Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
- Some plans include a minimum commitment period in exchange for a reduced rate; the applicable term, if any, is stated at checkout or in your organization's agreement.
- You can manage your subscription via the Stripe Customer Portal accessible from your account settings.
6.4 Wallet & Credits
Certain features use a credit or wallet mechanism (for example, a credit issued when a free assessment is completed, or a per-client credit wallet on practice plans). Credits are generally non-refundable once issued or purchased, are used to unlock the associated feature, and do not expire unless stated otherwise for a specific promotion.
6.5 Refunds
If you are not satisfied with a paid plan, contact [email protected] and we will review your request. Wallet and credit purchases are non-refundable once issued. Institutional contracts may have different terms as agreed separately.
6.6 Price Changes
We reserve the right to modify pricing with 30 days' notice. Changes do not affect existing subscription periods or locked-in Annual Commitment rates during their active term.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

8. Disclaimers and Limitations
8.1 No Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee:
- Uninterrupted or error-free operation
- Specific career outcomes or job placements
- Accuracy of predictions or recommendations
8.2 Career Guidance Disclaimer
NexPath provides data-driven career insights, NOT professional career counseling. Our recommendations are based on psychological assessments and labor market data, but:
- They are not a substitute for professional advice
- Individual results may vary
- We make no guarantees about employment or career success
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NexPath Oy SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, data, or opportunities
- Damages arising from reliance on career recommendations
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
9.1 By You
You may terminate your account at any time via account settings or by contacting support. Monthly subscriptions can be cancelled at any time, effective at the end of the current billing period. Annual Commitment subscriptions cannot be cancelled before the end of the 12-month commitment period (see Section 6.3). Wallet credit balances are non-refundable upon termination.
9.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay applicable fees
We will provide notice when reasonably possible, but immediate termination may be necessary for security or legal reasons.
10. Governing Law and Disputes
10.1 Governing Law
These Terms are governed by the laws of Finland, without regard to conflict of law principles.
10.2 Dispute Resolution
Any disputes shall be resolved through:

- Mediation: If negotiation fails, we agree to mediation in Helsinki, Finland
- Litigation: If mediation fails, disputes shall be resolved in the courts of Helsinki, Finland
10.3 EU Consumer Rights
If you are an EU consumer, you retain statutory rights under EU law that cannot be waived by these Terms.
11. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use after changes constitutes acceptance.
You may review the current Terms at any time at nexpath.app/terms.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with our Privacy Policy and any institutional agreements, constitute the entire agreement between you and NexPath Oy.
12.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
12.3 Assignment
You may not assign these Terms without our written consent. We may assign these Terms to a successor entity.
